Terms of Use

1. Description of Service

Kings of the Beach is a beach volleyball scoring, statistics tracking, and community app. The app allows you to score volleyball games from an Apple Watch, track game history and fitness metrics on iPhone, organize pickup sessions at local courts, and sync data across your devices.

2. Eligibility

You must be at least 13 years old to use the app. If you are under 18, you must have permission from a parent or guardian.

3. Account Registration

You may create an account using email and password or Sign in with Apple. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration. You must notify us immediately of any unauthorized use of your account.

4. User Content

You retain full ownership of all content you create in the app, including game records, notes, session descriptions, and any other user-generated content. By using the app, you grant Living Duality LLC a limited, non-exclusive, worldwide, royalty-free license to store, process, and display your content solely for the purpose of providing and improving the service. We will not use your content for advertising or share it with third parties without your consent.

5. Acceptable Use

When using the app, you agree to:

• Provide accurate game scores and information
• Treat other users with respect when using session scheduling and community features
• Not create fake sessions, spam, or misleading content
• Not use the app to harass, intimidate, or harm others
• Not attempt to access other users' data or accounts
• Not reverse engineer, decompile, or disassemble the app
• Not use the app for any illegal purpose

If you join a session, we ask that you honor your commitment. If you can't make it, cancel your spot so others on the waitlist can join.

6. Health and Fitness Data

The app integrates with Apple HealthKit to display fitness metrics including heart rate, calories burned, and step count. This data is used solely within the app to enhance your experience. We comply fully with Apple's HealthKit guidelines. Health data is never used for advertising and is never shared with third parties.

The calorie estimates provided by the app are approximations based on general activity levels and should not be relied upon for medical, dietary, or health decisions. The app is not a medical device.

7. Disclaimer of Warranties

The app is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Living Duality LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or personal injury, arising out of or in connection with your use of the app. This includes but is not limited to injuries sustained during volleyball games or other physical activities. Our total liability for any claim arising from the app shall not exceed the amount you paid for the app in the 12 months preceding the claim.

9. Intellectual Property

The app, including its design, code, graphics, animations, sounds, and branding, is the property of Living Duality LLC and is protected by copyright and other intellectual property laws. The Kings of the Beach name and logo are trademarks of Living Duality LLC. You may not use our intellectual property without prior written permission.

10. Session Scheduling

Session scheduling is a community feature that allows users to organize pickup volleyball games. Living Duality LLC is not responsible for the conduct of users at sessions, the accuracy of session information posted by other users, or any disputes between users. We reserve the right to remove sessions or suspend users who violate these terms.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the app at any time, with or without notice. We may also update these Terms of Use from time to time. Material changes will be communicated through the app or by email. Your continued use of the app after changes constitutes acceptance of the revised terms.

12. Termination

We may suspend or terminate your account and access to the app at any time, with or without cause, including for violation of these terms. You may delete your account at any time by contacting us. Upon termination, your right to use the app ceases immediately, but provisions that by their nature should survive termination will remain in effect.

13. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the app shall be resolved in the courts of Marin County, California.
